Please read these Terms of Use ("Terms") carefully before using the Eat ABQ application ("App") or website ("Site") operated by Osterberg Apps LLC ("we," "us," "our"). By downloading or using the App, you agree to be bound by these Terms.

1. Use of the App

Eat ABQ is provided for personal, non-commercial use. You may use the App to discover restaurants, save favorites, and explore food categories in the Albuquerque area. You agree not to:

• Reverse engineer, decompile, or attempt to extract the App's source code
• Use the App for any unlawful purpose
• Attempt to interfere with the App's normal operation

2. Restaurant Information

Restaurant data in the App (names, hours, categories, pricing, ratings) is sourced from Google Places API and refreshed periodically. We make no guarantees that this information is current, accurate, or complete. Hours, locations, and availability may change without notice. Always verify details directly with the restaurant before visiting.

3. Intellectual Property

The Eat ABQ name, logo, design, and original content are the property of Osterberg Apps LLC. Restaurant names and information belong to their respective owners. Nothing in these Terms grants you rights to use our intellectual property without written permission.

4. Third-Party Services

The App uses third-party services including Google AdMob (advertising) and Firebase (analytics and crash reporting). Your use of these features is also subject to the respective third-party terms of service. We are not responsible for the practices of these third parties.

5. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT ANY INFORMATION WILL BE ACCURATE OR COMPLETE.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OSTERBERG APPS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED $10.00.

7. Modifications

We reserve the right to modify or discontinue the App or these Terms at any time. Material changes will be indicated by an updated effective date. Continued use of the App after changes constitutes acceptance of the revised Terms.

8. Governing Law

These Terms are governed by the laws of the State of New Mexico, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Bernalillo County, New Mexico.
